    CONDITIONS OF SALE. 1. The highest bidder shall be the purchaser, and no person Bere retract a bidding; and should any dispute arise between two or more bidders, the Lot in dispute shall be offered again or not at the discretion of the Auctioneer, who is to be the sole arbi- trator of any matter in dispute during the Sale, and who also reserves the right of refusing any bidding and of withdrawing any Lots from the Sale.. The vendors teserve the right to bid. 2. No person to advance less than 6d. at each bidding; above eleven shillings, 1s.; above five pounds, 2s. 6d.; and so on, in proportion; or less at the discretion of the Auctioneer. The Auctioneers will use their discretion as to the acceptance of cheques, as in the ordinary course drafts must be cleared before the delivery of Goods. 3. The purchaser shall give in his name and address; and, if required, pay a deposit of 5s. in the pound in part, or the whole of the purchase-money. The deposit paid by the purchaser on any Lot shall be reckoned as a deposit on each and ail of the Lots booked in his name. 4. The Auctioneers do not guarantee the title to any Lot or Lots sold by them, and will not be responsible for any defect in such title. 5. The Lots must be taken away with all faults, imperfections, or etrors of description (excepting such as are evidently hidden and unperceivable), at the purchaser’s expense, within one week from the day of Sale; and the remainder of the purchase-money to be paid before the delivery or handing the same over to the purchaser, in default of which the Auctioneers will not. hold themselves responsible if the Lot or Lots. be lost; stolen, damaged or destr¢yed, but they will be left af the sole risk of the purchaser. Should a case arise on which an allowance is deemed necessary by the Auctioneer, he shall be at liberty either to retain the Lot or make such allowance, computing the same at the rate the Lot was sold for at the auction. No claim for shortage will be entertained unless the Lots are checked before leaving the Auctioneers’ premises. In cases where one buyer purchases more than one Lot, the whole of the account of all the Lots purchased is to be paid for before any one Lot is delivered. 6. In the event of any purchaser at this Sale neglecting to pay for and take away any Lot or Lots he or she may have purchased, and the same remaining for a longer period than one week from the date of Sale, such purchaser, in addition to the amount of the purchase-money, shall, upon each Lot so left, pay one shilling per week for warehouse room, and also five per cent. per annum interest on the amount of the said purchase-money—the same to be reckoned from the day of Sale to the time of clearing or re-sale. Lastly—Upon default in compliance with any of the above Con- ditions, the deposit money, if any shail have been paid, will: be forfeited, and the Auctioneers shall be at liberty to re-sell the ‘Lots as to which such defaults shail be made, at the purchaser’s expense, either by public Sale or private contract; but without. prejudice to the right of the Auctioneers enforcing the contract made at this Sale; and the deficiency (if any) on such second Sale, together with all interest, wareroom, and charges attending the same, shall be made good by the defaulter or defaulters at this Sale.
