And as the performing the Duties required by the Aft, will avoid the Penalties otherwife to be incurr’d, fb it will at the fame Time, leave every one at Liberty to try, if he pleafes, the Validity of it in the Courts of Law. U pon the'Whole, I am of Opinion that it will be mod advifeable for the Gentlemen of the Veftry to proceed and apportion the Tax in like Manner as they have hitherto done ; but they may, however, for the Satisfaction of fuch as are dubious, make a Minute in their Pariffi Books, referving to themfelves all Benefit and Advantage of Exception, in Cafe the Law ffiould be deem’d not in Force ; which, I conceive, will be fufiicient to put the Gentlemen of the Vedry on an equal Foot with other Perfons in this Refpeft, whild it prudently leaves, at the fame Time, the Point in Difpute to-be determined by the proper Judicature, J.
