Any Town Council or other like Body, having jurisdiction within any Corporate Town, Borough, City, or Place; or any Trustees or Commissioners, or other like Officers acting under the provisions of any Act of Parliament, for the Drainage, Paving, or Cleansing, or managing or directing the Police in any Town, Borough, City, or Place, or for any of the above purposes; or in case there shall be no such Town Council or other like Body, or no such Trustees or Conunissitners having jurisdiction or acting as aforesaid, in any Town, Borough, City, or Place, then the Guardians of the Poor, upon receiving a certificate in writing, signed by two duly qualified Medical Practi- tioners. 1848. The To^ra Council, or any Trustees or Commissioners for the Drainage, Paving, Lilitin», or Cleansing, or managing or directing the Police of any City, Town, Borough, or Place; or any other Body of a like nature; or any Commissioners of Sewers or Guardians of the Poor; on receipt of a notice in writing, signed by two or more inhabitant householders of the parish or place to which the notice relates. 1849. Seweb, Attthobit-? ., lehote functions, varying with each successive piece of legisla- tion since the term viasfirst used in 1865, may he illustrated hy the typical poicer of leioer'Con- strucdon- The Guardians, Directors, Wardens, Go- vernors, or Overseers of the Poor, or Parochial Board, or other like Officers having the management of the Poor, or acting under the authority of any local Act of Parliament for the Paving, Cleansing, Drainage, or Lighting any Town or Parish (so far as prosecutions are con- cerned J. Local AcTHoaifY (Under Sanitary Act of IB6^.) 1855. 1860. In anyplace within which the Public Health Act is or shall be in force, the Local Board of Health. In any other place wherein a Council exists or shall exist, the Mayor, Aldermen, and Burgesses by the Council, except iu the City of London and the libevtiea thereof) where the local authority shall be the Commissioners of Sewers for the time being ; and except in the City of Oxford and Borough of Cambridge, where the local authority shall be the Commissioners acting in execution of the Local Improve- ment Acts in force respectively in the said city and borough. In any place in which there is no Local Board of Health or Council, and where there are or shall be Trustees or Com- missioners under an Improvement Act^ such Trustees or Commissioners. In any place within which there is no such Local Board of Health nor Council, body of Trustees or Commissioners, and where there is or shall be a Board for the repair of the highways of such place, that Board. In any place where there is no such Local Board of Health, Council, Body of Trustees, or Commissioners, nor High- way Board, a Committee for carrying this Act into execution, by the name of *' The Nuisances Removal Committee, of which the Surveyor or Surveyors of Highways for the time being of such place shall be ea^ ojicio a member or members, may be annually chosen by the Vestry on the same day as the Overseers or Surveyors of Highways, and the first of such Cojn- mittees may he chosen at a Veslry to be specially held for that purpose; And such Committee may consist of such number of members as the Vestry shall determine, not being more than twelTB, exclusive of such Surveyor or Surteyflis, and of such Committee three shall bg!a quorum. In any place in which there is no such Local Board of Health, Council, Body of Trustees, or Commissioners, nor High- way Board, nor Committee appointed'as aforesaid, nor Board of Inspectors for Lighting and Watcliing, the Guardians and Overseers of the Poor, and the Sur- veyors of the Highways in and for such place. 1865. In any place in which there is no Local Board of Health or Council, and where there are or shall be Trustees or Com- missioners under an Improvement Act, such Trustees or Commissioners. In any place within which there is no such Local Board of Health, Council, Body of Trustees, or Commissioners, if there be a Board of Guardians of the Poor for such place, or for any Parish or Union within which such place is situate, such Board of Guardians; and if there be no such Board of Guardians, the Overseers of the Poor for such place, or for the Parish of which such place forms part. In addition to the above Bodies, Highway Boards and Nuisances Removal Com- mittees were empowered by section 3 of the statute 23 and 24 Vic, c. 77, to take action under the Nuisances Removal Acts. The section is as follows :— That.in any Place where a Highway Board or ' The Nuisances Removal Committee ' chosen by the Vestry in pursuance of the Slid Act is snbsisting, and at the time of the passing of this Act employs or joins with other Local Authorities in employ- ing a Sanitary Inspector or Inspectors, such Highway Board or Nuisances Re- moval Committee may continue to act, and a like Committee may be annually chosen by the Vestry for such Place in the same mELuner as if thli Act had -not been passed ; but in case in any year the Nuisances Removal Committee be not chosen for such Place in manner provided by the said Act, or if the Highway Board or Committee now subsisting or hereafter chosen fail for two months in any year to appoint or employ a Sanitary Inspector or Inspectors, the authority of such'High- way Board or Committee shall cease, and no like Committee shall be chosen for such Place, and the same Body or Persons shall thenceforth be the Local Authority for the Place as if no such Highway Board or Committee had been appointed therein. Same as in 1860 1866. 1867. [TheSanitary Actpassed in this year made an alteration in the local authorities for nuisance purposes. Section 17 of the Act directs that all powers vested in any Highway Board or Nuisance Removal Coramittes under the Nuisances Re- moval Acts shall determine. The effect was, that from and after August 7, 186G, Nuisance Removal Committees and High- way Boards ceased to be Nuisance Au- thorities, and the only Authorities having power under the Acts are as follows:—] In any place within which the Public Health Act is or shall be in force, the Local Board of Health.
