C 21 ) 2 2, Whether W.IV. his Patent was expired as to the ttms, is no-* thing at all to thepurpofe. fince by Mr, FitzG.and his Partners, it had been obib'ii(5ted, and by their means ordered to be vacated : for the Prayer odF, VF, his Petition to the Houle of Gommons, and the intent of the Bill was. That Wh W. might be rejbend to his Rights (viz, reftored by having an Adof Parliament, not by having his Old Pa¬ tent in Force again And have his Term which hath been tnterruped^ renewed^ and enlarged; wherefore his Bill was to renew his Term,^ as well as to enlarge it j becaufe of their getting a Patent to them- lelves, and their procuring an Order, that his Patent fiaould be va¬ cated, whereby they obhruded his Proceedings: So that he having once obtained a Patent, and having before his Patent granted, had the grand Right of an Inventor, which is ftill fufviving, and is al¬ ways to continue, the Obftrudions of his Right by their procuring a Patent, and by their otherwife oppofing his Patent, and caufing an 'Order to vacate it, and the necefiity of palling the Ad: for the Pub- lick Benefit, not the firlf limited time of the expiration of his Pa¬ tent, were the Ground of the Bill, 3 3 was Summoned to appear before the King and his Counleh and had Counfel learned, who llrongly oppofed the vacuingof his Patent, and the other Contents of His Majelly’s Older, till His Majefty had put an end to the Hearing; fo that Mr. FitXj G. urgech diredly contrary here to what he hath acknowledged in this his State of the Cafe. See pag.y. and his own Knowledge, for he being pre¬ lent, law that FFl/K did withftand the vacating of his Patent by bis Counfel, as long as they were fuffered to Ifay till the Hearing was over, and that both lir. FF. and his Gounfel, and all that attended on his Account by Command, had withdrawn. 34 No fuch thing did or could appear at the Hearing either before the Committee of the Houfe of Gommons, or before the Committee of Lords,as all, that were there can tellifie. Let the World therefore judge whether thefe Infinuations are not frivolous and unjuft pretences. Mr, by the liberty he ufually takes in his Expreflions con¬ cerning Vy, FF. and by his Refledlions upon him, labours to alie¬ nate Mens minds from the defire of employing him, and would make them believe that he deferves not to have any Encouragement given him ; but it is well known IF, FF, hath been often put to the feve- reft proofs of his Temper, of the truth of ids Words, and the fuf- ficiency of his Experiments, yet therein was never found to come oft with Diftionour, wherefore he hopes, he hath given no occafi- on for others upon any of thefe perfons Allegations, or on whate¬ ver account elfe, to diftruft his Credit, or fincerity in any thing.
