D if miffed. a # JOHN GILLOCH weight in Dalnakebock, aged twenty-fix years, married, purged of malice and par¬ tial counfel, fworn, and interrogate, depones. That, about a fortnight after Eaftmiln’s marriage, the depo¬ nent was fent for to the houle of Eaftmiln to put on iome locks and brafs-work upon a drawer : That according¬ ly the deponent went to the room where the drawers Rood, in which room he law the pannel Mr Ogilvie lying in bed : That when lie was fo employed, Mrs Ogilvie the pannel came to the room-door where the deponent was at work, Ihe having heard him, as he fnppofed, at work. Upon'Mr Ogilvie the pannel ob- ferving her, he defire J her to come in: That after having laid to°the deponent, John, are you begun? Ihe went in and alked Mr Ogilvie the pannel. What! Are not you up vet ? and then Ihe went towards the bedlide, where flood a little died, upon which Ihe fat down, and then they eat fome fweet bread together, which had been got at a market. Depones, That he ob- ierved her hand about the bed-cloaths, juft upon Lieutenant Ogilvie’s bread ; at which time Ihe laid to him, You are not. poor, but pretty fat ; but did not obferve whether her hand was below the bed- cloaths, or above. Depones, That when Mrs Ogil- vie the pannel was going out of the room, Lieutenant Ogilvie kicked up the bed-cloaths with his feet, and threw them up upon liis body; upon which Mrs O- gilv.ie laid, Ah 1 you daft dog ! and the deponent at that time law fo much of the laid Lieutenant Ogil¬ vie’s body, that he, the deponent, could judge ..whe¬ ther he was a man or a woman : That, alter break- fall, Mrs Ogilvie came to where the deponent was at work, and gave him a dram ; and Lieutenant Ogilvie being prelent, Ihe gave him alfo a dram, for he was by that time drelfed.
