![permitted to be called. in queftion ; for inftance, when it hath been neceflary to diftinguifh, whether lands were held 7 ancient demefne or in what other manner, recourfe hath always been had to Domes-day book, and to that only, to.determine the doubt. If lands were fet down in that book under. the title of terra regis, or. if. it was faid there, rex habet fuch land, or fucha town, it was then: determined to be the king’s ancient demefne, If the land or. town was therein fet down under the name of a private lord or fubje€t, then it was deter- mined to have been at the time of the furvey the land of fuch private perfon, and wot anctent demefne. _ The tallages formerly affefled upon the king’s tenants in ancient demefne, were ufually greater than the tallages upon perfons in the party aggrieved of fuch tallage, in:cafe, upon fearch of Domes-day beck, the barons found the lands were not in ancient demefne (/). The care originally taken for the prefervation of this furvey, she fame as was taken of the king’sfeal, is an additional proof, of the con- lick. The Dialogus de Scaccario fays, “* Liber ille [Domes-day] figilli «regis comes eft individuus in thefauro (g).” chamberlairis of the Exchequer, and was not to be opened but on paying a feeof 6s. 8d. It is now depofited in the chapter houfe at Weftminfter, among other valuable records in the cuftody of Mr. Morley, whofe readinefs to oblige the members of this fociety with the infpection of this, and other records in his office, without fee or reward, it would be want of candour not to mention. “(f) Madox Firma burgi, p, 5, 6.
