![9. And, that (as often as any of the faid three fellowfhips or eight fcholarfhips fhould, by any manner of means, become void, during the life of the laid then & now earl) it fhould be lawfull for the faid earl (within xxx. days next enfuing after notice Ihould be to him given of fuchvoydance by the mailer, fellows & fcholars of the faid college under their common feal) to nominate & appoint, unto the laid mailer, fellows & fcholars, under his hand & feal in writing, one meet perfon of the faid univerfity, not being under the degree of batchelor of arts, for every fuch of the faid three fellowihips as fhould then be void ; & one meet perfon for every fuch of the faid eight fcholarfhips as ihould then alio be void ; which faid perfon or perfons, fo to be nominated & appointed as aforefaid, the faid mailer, fellows & fcholars fhould forthwith admit of into the laid fellowihips & fcholarfhips refpedtively. 10. And furthermore, whereas it was, by the faid writing indented, mutually covenanted, concluded & agreed, by & between all the parties thereunto, that, whenfoever & as often as any of the laid three fellowihips or eight fcholarfhips fhould become void, by any ways or means wnatfoever, after the death of the faid earl partie to the faid writing indented, they the faid mailer, fellows & fcholars fhould, within xxx. days next enfuing after fuch voydance, under their common feal, nominate & prelent unto the faid earl his heirs male (being earls of Exeter) two learned & meet perfons of the faid univerfity, being not under the degree of batchelor of arts, for every fuch of the faid three fellowfhips as fhould then be void; & two meet fufficient perfons for every fuch of the faid eight fcholarfhips as fhould then alfo be void: of which perfons fo nominated & prefented, the earl of Exeter for the time being (being an heir male of the body of the faid then & now earl) within xxx. days after fuch no¬ mination & prefentation, ihould or might chufe & eleft one of them to be admitted into fuch of the faid fellowfhips or fcholarihips refpedlively, as they fhould be fo nominated & pre¬ fented unto: 11. And, upon fignification of fuch choice & eledlion made by the faid-earl of Exeter for the time being under his hand & feal, unto the faid mailer, fellows & fcholars for the time being, they the faid mailer, fellows & fcholars fhould forthwith admit the faid fellows & fcho¬ lars fo chofen & eledled, into the faid fellowihips refpedlively, whereunto they fhould be fo chofen & defied: 12. And, in default of fuch choice & eledlion by the faid earl of Exeter for the time being, to be made within the time aforefaid, it fhould & might be lawful to & for the faid mailer, fellows & fcholars, & their fucceffors, within ten days next & immediately enfuing fuch de¬ fault, to admit one of the faid perfons fo nominated & prefented, into fuch fellowfhip orfcho- larfhip reipedlively, as the faid perfon fhould formerly be nominated & prefented unto; as by the faid writing indented, more fully & at large it doth & may appear. 13 It is now mutually covenanted, concluded & agreed, by & between all the parties to thefe prefents, that, as well for & during the life of the faid earl partie to thefe prefents, as alfo for & during the life of the right honorable Sir William Cecil knight. Lord Burghley., eldefl fon & heir apparent unto the faid earl, the faid recited covenant for the nomination, prefentation, choice, election & admiffion of the faid three fellows & eight fcholars fhall be duly kept & performed in all things, according to the form & order in the faid recited cove¬ nant comprifed: 14. And that, from & after the death of the faid earl & of the faid Lord Burghley his eldefl fon, it fhall & may be lawful], always from thenceforth, unto the faid mailers, fellows & fcholars, & their fucceffors, as often as any of the faid three fellowfhips or eight fcholarfhips fhall become void, to ufe the fame or like form of nomination, eleflion & admiffion of meet & convenient perfons into every of the faid fellowfhips & fcholarfhips refpeflively which fhall fo happen to be void, as heretofore the faid mailer, fellows & fchoiars have ufually done, ac¬ cording to the flatutes & ordinances of their faid college, in the nomination, eleflion & ad- miffion of the other fellows & fcholars refpeftively, which formerly have been maintained within the faid college; the faid recited covenant, or any other claufe or article in the writing indented contained, to the contrary thereof, in any wife notwithflanding : 15.
