    owner or occujiier, by a court of summary jurisdiction Sec. or by arbitration. If a house within the district of a 23 L. A. has not a proper drain, notice shall be given in writing to the owner or occupier to make a covered drain emptying into a sewer which is not 100 feet from the house, but if no such sewer is available the drain may be led into a cesspool not under any house, and the drain must be made of such materials and laid as the L.A. direct. If the order is not complied with within a reasonable time, L.A. may make the drain and recover expenses for the work. But if L.A. are of opinion that it would be chea])er to make a new sewer foi' the drainage of two or more houses, they may construct such new sewer, and share the expense among the owners or occupiers of the houses draining into it, recovering the cost in a summary manner, or tliey may declare the same as private improvement expenses. This section and the next apply to U.A. and R.A. If a ch-ain, although sudi- 21 cient for the drainage of a house, is not adapted to the general sewage of the district, the L.A. may close such drain on condition of providing another, at their expense, erjually effectual and communicating with the new sy.stem. No house in an urban district must be 25 built or rebuilt, or occupied without a j)roper drain opening into a sewer not distant more tlian 100 feet from such hou.se, or into a covered cesspool if there be no convenient sewer. A penalty of not more than £50 shall be imposial for any contravention of this section. Any person, without the writtcm consent of cg U.A., cau.sing any building to be newly erected over any sewer, or making any vaidt or cellar under the
