Tims, if a L.A. wishes to have exclusive right to the water of a stream, they must buy up the rights of all the jiroprietoi's belo^v them. A landowner has perfect right to appropriate all surface water not flowing in a distinct channel, although he j)revents such surface water from reaclung a watercourse whicli it jjreviously supplied (Broadbent v. RnmsboUoni, 11 Ex., Rep, 602); he may also drain his land for agricultural purposes. 52 Before commencing to construct waterworks within the limits of sup])ly of any water company em}iowered by Act of Parliament, or any order confirmed liy Par- liament to sup|)ly water, the L.A. shall give written notice to every water company within whose limits of suppl}^ the L.A. are desirous of sup[ilying water, stating the purposes for which, and—as far as may be practic- able—the extent to wliich water is re(piired by the L.A. No L.A. is permitted to construct any water- works within such limits so long as there is any company able and wdlling to sup[)ly water proper and sufficient for all reasonable purposes for wliich it is recjuired by the L.A.—(Richmond Wate.rworhs Co. and Southwark and Va}ixhall Waterworks Co. v. Richmond Veslrij, L.R. 3 Ch. 21.-82)—and any dilference as to ability of the company to sup])ly the water, or as to the (piality or tpiantity of the water supplied, or the charges, dm., for the same, shall be settled by arbitra- 63 tion. A L.
