And that should the legislature hereafter think proper, which is Dot very probable, to dispose of the same to private individuals, for building lots, it would be tor their interest first to lay open the said str To meet the possibility of such an event, Dr. Hosack has procured from sundry persons, owning lots adjacent to, and in the vicinity of the botanic •:, :i certificate expressing their assent to a cession by the corporation, of the grounds reserved for streets, as far as they may be concerned, believ- ing thai the institution would prove a benefit to the city and the community at large, « bich certificate accompanies this report, and is signed, as the corn- informed, bj all the persons, except one, owning property adjoin- ing the garden on ihc east and west sides. The only remaining objection to the ground reserved for streets, rela the street on the south westerly side of the garden, and is inclosed within the tame V four committee understand, that the lot of land, adjoining the botanic gar- den on the south westerly side is ov. ned by the corporation ; but is subject to , now belonging to the heirs or executors of Caspar Sander In pi of tune it maj be necessary to open a street on that side of the garden, and should the corporation release their right to the street reserved on thai of the garden, it would be necessary in such case, for the corporation cither to purchase the same of the state, or to lay out a street upon then- own lands, adjacent to the garden. To provide for such an event, and to in- demnify the corporation against any loss that might arrive therefrom, your committee suo-o-cst the following propositions for their consideration, viz : 1st ThatDr Hosack purchase from the corporation, the ground r< for a street, on the south westerly side of the garden, at the price per acre, or lesser quantity, at which the same was valued and estimated to him by the appraisers, appointed under the act of the legislature, paj able out Ql tlic pro- ceeds of the lottery granted for the purchase of the botanic garden, at the time when the same shall be drawn; or 2d. That Dr. Hosack convey to tin- corporation the same quantity of land in the vicinity of the garden, ot equal value, in exchange for the said street. „ . . , -,, t. ,t.
